A regular meeting of the Board of Trustees of the Village of Sleepy Hollow tvas held
on Tuesday, August 28,2001 at 8 PM in Village Hall, 28 Beekman Avenue, Sleepy
Hollow, New York.

Deputy Mayor Mario DiFelice called the meeting to order with a pledge to the flag.
Deputy Mayor DiFelice asked that everyone remain standing for a moment of
silence for Florence Gregg, the mother of Trustee Patricia Rodriguez who passed
away last week.
Public Hearings-None
Approval of Minutes
Trustee Stever moved, seconded by Trustee Zieja to approve the minutes of June 19,
2001, motion carried 4-0.
Trustee Stever moved, seconded by Trustee Zieja to approve the minutes of July 17,
2001, motion carried 4-0.
Trustee Stever moved, seconded by Trustee Zieja to approve the minutes of July 24,
2001, motion carried 4-0.
Trustee Zieja moved, seconded by Trustee Hart to approve the minutes of August
21,2001, motion carried 4-0.
Public Comments

•

Don Caetano commented that he felt that the village codes and ordinances are not
being enforced properly. He felt that all residents are not being treated equally
when it comes to enforcing these laws.
Miguel Jimenez commented that he had the same concerns. He felt that some
residents can do whatever they want without permits, etc and others are told they
need to follow the code. He also questioned the duties of the Director of Fire and
Life Safety and if he had the power to supercede the Building Inspector. Trustee
Stever and Brian Murphy, Village Attorney tried to explain to Mr. Jimenez the
function of this department Deputy Mayor DiFelice stated that he could come in to
village hall and get a copy of the ordinance regarding the Department of Fire and

Life Safety and the duties of the Director of Fire and Life Safety. This will answer
any questions he has.

Mr. Jimenez questioned the PILOT agreement the village will have with Kendal on
Hudson and Trustee Stever explained it is not the same type of PILOT agreement
with General Motors back in 1985.
Approval of Warrants

Trustee Hart moved, seconded by Trustee Stever to approve the warrants of August
28,2001 and authorize the Treasurer to pay the bills, motion carried 4-0. The total
of the General Fund is $380,372.39 total of the Water &amp; Sewer fund is $19,927.44
and the total of the Capital fund is $225,151.30.

Be it Resolved that the Board of Trustees does hereby approve the appointment of ~
Modesto Martinez, 5 Clinton Street, Sleepy Hollow, New York to the position of full
time Laborer effective August 29,2001 at an annual salary of §38,920.50 for a
period of eighteen months which is 90% of the total salary of S43,245.00. Said
appointment is subject to a probationary period of twelve to twenty-six weeks and
subject to the approval of Westchester County Civil Service.

RESOLVED, that the Board of Trustees authorize the Village Mayor to
execute an inter-municipal agreement with the Village of Tarrytown for sharing of all
costs and expenses of operating, maintaining and repairing the land building and facilities

of the Warner Library ("Library"), for the period June 1,2001 through May 31,2003
subject to review by the Village attorney's office.

NOTICE OF INTENT TO
BECOME LEAD AGENCY

WHEREAS, the Mayor arid Board of Trustees (the Village" Board) for the Villageof Sleepy Hollow has
received an application for Special Permit approval and Concept Plan approval pursuant to Section 625.1.H of the Sleepy Hollow Zoning Code from Ginsburg Development, LLC (the Applicant) for the
development of 50 residential units and 9,500 s.f. of commercial space on 3.4 acres of upland area within
the RF-Riverfront Development District (the Project) located at River Street and Beekman Avenue in the
Village of Sleepy Hollow, New York; and
WHEREAS, the Village Board determined that there is a facially complete application in which to initiate
the State Environmental Quality Preview Act (SEQRA) procedures; and
WHEREAS, a Lead Agency must be established for the environmental review of the proposed action,
pursuant to the requirements of SEQRA; and
WHEREAS, the Village Board is interested in becoming Lead Agency in this matter; and
NOW THEREFORE BE IT RESOLVED THAT, the Village Board of the Village of Sleepy Hollow
declares its intent to become Lead Agency for the purposes of reviewing the proposed special permit
application and concept plan approval.
The Village Board will distribute this resolution to all other potentially involved agencies and afford them
30 days in order to comment on the intention of the Village Board with regard to Lead Agency.
