Present: Mayor Philip E. Zegarelli Mario DiFelice Richard Zieja Patricia M. Rodriquez James Hart Donald Stever Trustees Also Present: Dwight H. Douglas, Village Administrator Brian Murphy, Village Special Counsel At 7:00 p.m. Mayor Zegarelli called a special meeting of the Board of Trustees into executive session in to order to consider and discuss the status of negotiations with GM and pending litigation. The Board came out of executive session at 8:05 p.m. and immediately commenced the open session portion of the special meeting. Mayor Zegarelli re-capped the current status of negotiations with General Motors without going into specifics, noting that progress had been made in our negotiations with General Motors and that General Motors and the selected developer, Roseland, had completed negotiations regarding some thorny issues and that project plan development should now move forward smoothly. The Mayor and Trustees discussed police summer manpower needs wiih Chief Warren and concurred that the south post be manned with two officers during the 4—12 p.m. shift, one on foot or on bike, on Friday, Saturday, Sunday until Labor day. Prior to the Public Hearing on the powers of the Director of Fire and Life Safety, Village Counsel, Brian Murphy, read into the record a letter from Village Prosecutor, Robert Pierce regarding said powers. The letter is attached hereto and made a part of the recordAt 8:40 p.m. a public hearing to receive comments on proposed legislation clarifying and amending the powers of the Director of Fire and Life Safety to issue violations was called to order. There were several comments recommending that the position be left unchanged and the Building Inspector retain sole responsibility for the issuance of code violations. Commentators noted that: they felt Civil Service laws would require that the two positions be occupied by separate individuals; that there were problems with the level and quality of code enforcement being carried out by the office of Fire and Life Safety that would only be compounded if the two positions were combined. Zegarelli, Mayor Village of Sleepy Hollow 28 Beekman Avenue Sleepy Hollow, New York 10591 RE: BUILDING & ZONING CODE VIOLATIONS Dear Mayor Zegarelli: I am writing to confirm my request as Village Prosecutor that Sleepy Hollow's local lav/ be amended to enable the Director of the Department of Fire & Life Safety to assist in the prosecution of Building & Zoning Code violations. ' Since it is unclear under the present Village ordinance whether anyone other than the -Building Inspector may issue violation notices or sign criminal informations in connection with violations, the requested amendment will resolve that ambiguity. The proposed amendment will enable my office greater flexibility in connection with the prosecution of these violations. Additionally, it will save time and money by eliminating the necessity of having the Building Inspector reinspect violations discovered by the Fire & Life Safety Director durina his inspections. �/^7 I VILLAGE OF SLEEPY HOLLOW NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that a public hearing will be held by the Board of Trustees of the Village of Sleepy Hollow on July 9, 2002 at the Municipal Building, 28 Beekman Avenue, Sleepy Hollow, New York 10591 regarding the adoption of a Local Law of Village of Sleepy Hollow for the year 2002 which would amend Chapter 19D (Fire and Life Safety Department of) by authorizing the Director of the Department of Fire and Life Safety to administer and enforce the provisions of the Village Code and New York State Fire Prevention and Building Code, [proposed new language in italics] A. I §19D-3. /j ESTABLISHMENT OF OFFICE OF DIRECTOR ' There is hereby created the office of Director of the Department of Fire and Life Safety of the village. The Director shall have primary responsibility for the administration and enforcement of the provisions of this Code and shall supervise the personnel assigned to and activities of the Building Department that end shall supervise the activities of the Building Inspection division and code enforcement division. Wherever in this Code authority is vested in a Building Inspector or a Code Enforcement Officer to administer and enforce any provision of this Code or the New York Stale Fire Prevention and Building Code, such authority shall also be vested in the Director of the Department of Fire and Life Safety. Any resident of the Village of Sleepy Hollow is entitled to be heard upon said proposed Local Law at such public hearing.
