Present: Mayor Philip E. Zegarelli Mario DiFelice Richard Zieja James Hart Robert Higle Donald Stever Trustees Also Present: Dwight H. Douglas, Village Administrator Brian Murphy, Village Special Counsel Jimmy Warren, Police Chief Nat Federici, Village Engineer David Smith, Village Planner At 7:05 p.m. Mayor Zegarelli called the work session to order to review a number of items regarding manpower and other government business. At 7:55 p.m. on a motion of Trustee Hart, Seconded by Trustee Zieja the Board went into executive session to review contract negotiations and pending litigation. At 8:23 the board came out of executive session. Trustee Stever was called awayfromthe meeting at 8:20 p.m. At 8:26 p.m. Mayor Zegarelli called a special meeting of the Board of Trustees to order. Mayor Zegarelli then read into the record the attached legal notice regarding a public hearing held to review prospective changes to the Waterfront Consistency Review procedures. Dave Smith gave a brief overview of the proposed procedural change to provide the Waterfront Advisory Committee greater timingflexibilityparticularly for projects involving environmental impact statements. No resident spoke in opposition to the proposed change. On a motion of Deputy Mayor DiFelice, seconded by Trustee Hart and unanimously approved, at 8:47 p.m. the public hearing was closed. The annexed resolutions and appointments were acted on as shown. At 9:05 p.m., on a motion of Trustee Zieja, seconded by Trustee DiFelice and carried unanimously, the meeting was adjourned. (5) The Facility will not cause unacceptable interference with the frequencies of any radio, television, telephone or other uses. (c) Based upon the data and analyses presented, the following findings are made regarding environmental impacts to be expected from the proposed Facility: (1) The project will result in no impacts to grcund or surface water quality, air quality, ambient noise levels or public utility service because the*Facility is unmanned and will not produce any smoke, gas, odor, heat, dust, noise, fumes, vibrations ox flashing lights; and the Facility will not generate solid waste, waste water or sewage, will not require water supply or waste disposal, and will not attract insects, vermin or other vectors, (2) The project will not result in any potential health effects to humans and will not cause any electrical interference for surrounding residences because the Facility will comply with all applicable FCC emission and electrical interference standards and regulations. (3) The project will result in minimal disturbance and the Faciliry will not impact any wetlands. (4) The project will have no impact on area roadway operating conditions because it will result in no significant traffic generation since the proposed use is unmanned requiring infrequent maintenance visits of approximately once per month- (5) The project will not result in the removal of any vegetation ox fauna, will not adversely affect any endangered species of plant or animal, and will not result in any significant adverse impacts to natural resources. (6) The project will not adversely affect the character or quality of important historical, archeological, architectural or aesthetic resources. (7) The project will not create a substantial change in use, or intensity of use of land or other natural resources or the area's capacity to support existing uses because of its location on the existing Building and because the Facility will not produce any smoke, gas, odor, hear, dust, noise, fumes, vibrations or flashing lights. (10) No significant impacts have Been identified as a result of the Proposed Action when assessed in connection to its setting, duration, geography, scope, magnitude and number of people affected. In identifying and analyzing the areas of environmental concern, the Village Board has examined both the potential impacts of the construction and ultimate development of the project in accordance with the plans and specifications as presented. The Village Board has reviewed the proposed Agreement and associated information. Wc have also reviewed these areas of concern in the context of SEQR Regulations Part 617.7, which sets forth a comprehensive criteria for determining significance, including potential long term, shot; term and cumulative impacts. • Based upon the evidence before the Village Board, the Village Board has concluded mat the proposed action will not have a significant impact on the environment. The Village Board has also determined that the proposed action will not have significant long-term, short-term or cumulative impacts. Moved by: Trustee DiFelice, Seconded by: Trustee Zieja, Vote: 5-0 Date: October 1,2002 Resolution #2 �3 to I Meeting Date: 19/Q1/02 Resolutions /f 10/142/02 •> ., <. - 0 WHEREAS, it is important to protect our children throughout the year from aggressive drivers and preventable traffic injuries; and each day during the school year an estimated 50,000 motorists illegally pass stopped school buses in New York State; this is a major concern of "Operation Safe Stop" - an education and enforcement program sponsored by y New York State and its local government partners; and I WHEREAS, "Operation Safe Stop" is a cooperative project supported by the Governor's Traffic Safety Committee, the State Departments of Motor Vehicles, Education and Transportation, the Division of State Police, and the New York State Association of Pupil Transportation, the New York State School Bus Contractors Association, and state, county, city and local law enforcement agencies; this excellent program helps inform motorists, school bus operators, law enforcement agencies, school administrators and the general public about dangers that children encounter as they approach and depart from school buses throughout the school year and the traditional periods of school vacation; and WHEREAS, "Operation Safe Stop" expanded to statewide service in 1997 from its beginning as a regional safety effort more than ten years ago; this innovative safety effort has helped reduce the number of students deaths and injuries, and is a recognized example of effective safety education and public outreach; and I WHEREAS, throughout the nation, October 20-26 has been designated as a weeklong observance of school bus safety education, which emphasizes the need for motorists to exercise caution throughout the year when approaching school buses and other passenger buses, all motorists should prepare to stop on school grounds and all roadways, including while driving in either side of a divided highway, whenever a school bus displays flashing yellow lights, and completely stopping when the bus lights flash red; it is fitting for New Yorkers to support this observance and make the effort to improve safety with regard to school buses and our precious children who ride them; NOW, THEREFORE, I, George E.
