Present: Mayor Philip Zegarelli Mario DiFelic James Hart Donald Stever Richard Ziej a . Robert Higle Trustees Also Present: Brian Murphy, Village Attorney Absent: Trustee Patricia Rodriguez Dwight Douglas, Village Administrator Mayor Zegarelli called the meeting to order with a prayer and pledge to the flag. He asked that everyone remain standing for a moment of silence for Walter Kane who passed away this week. He was a long time resident of this village. Public Hearing Mayor Zegarelli commented that this public hearing is a continuation of the previous public hearing held in October regarding Ichabod Landing DEIS. David Smith, Vice-President of Saccardi & Schiff, Planning Consultants, commented that tonight is a continuation of the initial public hearing on the draft environmental impact statement on the Ichabod Landing project. He commented that there is a stenographer who is taking the minutes of this hearing and all comments and letters will be entered into those minutes and there is still time for anyone wishing to send comments to the Mayor and Board to do so. Joel Sachs, Counsel for the Village on this project, commented that it is fairly early on in the environmental review process and the Board is here to hear comments from the public. Henry Hockerman, Attorney for the applicant, also gave a brief overview of the project. Mr. Williams, representative of the YMCA commented that there is a need for more recreational services at the new proposed project. Bruce Lozito, applicant, stated that this project is not a large project for all these different facilities. The GM site would be the place for something like that. Mayor Zegarelli read a letter from Roseland with regard to Ichabod's Landing which will be made part of the official minutes taken by the. stenographer. Don Caetano suggested that they work out some plan for installing a bathroom at Horan's Landing in their proposal. Mario Belanich had several questions regarding this proposed project He was asked o submit them in writing and he will receive a response in writing. 1 j �^ Michael Doorley presented some pros and cons on the project. There being no further comments, Trustee DiFelice moved, seconded by Trustee Stever to leave the public hearing open until December 20, 2002 to receive any written comments that the public might have, motion carried 6-0. On roll call; Trustees DiFelice, Hart, Higle, Stever and Zieja and Mayor Zegarelli voted yes. Mayor Zegarelli read the attached public hearing notice regarding amending Chapter 57-20D and gave a brief explanation. Bill Patten whose mother lives on Dell Street, presented the Board with a petition and other written material in opposition to the proposed "No Parking" on the north side of Gordon Avenue. (Part of Official minutes) Don Caetano commented that there are always many cars that hang out of their driveway on that street. There being no further comments, Trustee DiFelice moved, seconded by Trustee Higle to close the hearing, motion carried 6-0. Mayor Zegarelli commented that the board will discuss this at the next work session. Approval of Minutes Trustee Higle moved to approve the minutes of October 8, 2002, seconded by Trustee DiFelice and motion carried 6-0. Trustee Higle moved to approve the minutes of October 22,2002, seconded by Trustee Zieja and motion carried 6-0. Approval of Warrants Trustee Higle moved, seconded by Trustee Hart to approve the warrant of November 12,2002 subject to review and approval by the Mayor and Village Administrator. Total of the General fund is S222,870.49,total of the Water & Sewer fund is $27,395.32 and the total of the Capital fund is $59,872.06. Mayor's Announcements Mayor Zegarelli commented that a group of Armenian Village Officials will be visiting our village on Thursday and we will be taking a tour of the General Motors site. Public Comments-None Trustee Reports Trustee DiFelice read the attached public works report. He commented that the Police Department has received the Platinum award from AAA for traffic safety on October 29,2002. New York City and White Plains have also received this award. Mayor Zegarelli presented the plaque to the Police Chief. Our village has also received the Pedestrian Safety Award for many years now. 2 �Trustee DiFelice commented that at the recent Public Safety meeting, several issues were brought up. One was that many homes in the village do not have house numbers, tag sale signs not being removed in a timely manner and the red light at the corner of Beekman Avenue and Washington Street is causing a problem when a pedestrian is crossing at that intersection. Trustee Stever reported that he met with the Attorney, Administrator and business people of Duracell/Gillette last week to discuss the terms of the pending acquisition by the village of the Duracell property. Although he could not discuss the substance of the discussion but he commented that the discussions went well. The Mayor commented that Governor Pataki has given the village a $300,000.00 grant for improvements to Barnhart Park. Mayor Zcgarelli stated that the meetings in December will be December 3 r (worksession), December 10th (board meeting) and December 17l will be our Annual Day of Remembrance which is the anniversary of the village. We will have a very short meeting, if needed, followed by refreshments. Trustee Stever moved to confirm these dates, seconded by Trustee DiFelice and carried. Resolutions-Attached New Business Mayor Zcgarelli stated that Trustee Stever's wife Margo received an award from the Writers' Center on the book that she has written and congratulated her. Communications, Petitions & Requests Village Clerk read correspondence from CND of New York, located at 60 Clinton Street notifying the Village of their intent to renew their liquor license. (Copy to Police Chief) Village Clerk read a letter of resignation from Trustee Rodriguez addressed to the Mayor.(Part of official minutes). Mayor Zcgarelli accepted her resignation with sincere regrets and thanks for the time she has given the village as a trustee. Trustee DiFelice moved, seconded by Trustee Zieja to accept her resignation, carried. Mayor Zegarelli appointed Richard Spota, former Police Chief for the Village of Sleepy Hollow, as a trustee to fill the vacancy created by the resignation of Patricia Rodriguez. Mr. Spota was then sworn in as trustee by the Mayor. There being no further business, Trustee DiFelice moved, seconded by Trustee Higle to adjourn the meeting, carried. Y. 10591 Mayor and Board of Trustees 28 Beekman Ave. Sleepy Hollow, N.Y. 10591 Dear Mayor and Trustees, I am writing to you in regards to the public hearing to be held on Tuesday, November 12,2002 concerning the prohibiting of parking for a 6 foot section on the north side of Gordon Ave. As you are well aware, this has been an ongoing problem for those of us who live in this neighborhood for many years. I am currently a resident of 12 Dell St., and I lived for 45 years at 225 Gordon Ave., across the street from the parking area in question. f There has been at least 30 years of harrassment by the residents of 14 Dell Street concerning where cars are parked. I am one of many who have received many notes on their cars and verbal threats by them because they did not like where our vehicles were parked. The notes complained that I was parked near or across their walkway. Isn't it interesting that they claim they need their walkway clear for the elderly person that lives there, when in fact this is just an obsession on their part to control where people park. I have heard them tell people that they could not park on the street because they were not homeowners. ISN'T THIS A PUBLIC ROAD?? What was their excuse for the past 30 years? This woman hasn't always been old. She manages to go to bingo several times a week, take the garbage out on a regular basis (and leave the cans on their walkway) and otherwise lead a normal life. This has nothing to do with her or her health and everything to do with her daughter's compulsion to control who parks where on Gordon Ave. Recently, giving in to them, even though my landlady was told by Trustee Di Felice that the village was NOT going to paint lines, the Village painted yellow lines in front of the walkways of 12 and 14 Dell St., at the request of the residents of 14 Dell St.. Those of us who live at 12 Dell St. were not consulted about this as we should have been, being that it does affect us. It was not requested by us and should have nothing to do with what the people of 14 Dell St want Frankly, why they haves this compulsion, I cannot understand. She has unlimited free parking on Dell St in the William Smith Memorial parking lot They also have easy access to that parking area. My conclusion is that that she wants that 6 foot area on Gordon Ave. open so she can zoom in and out of a parking place whenever she wants. Please see the pictures enclosed- You will note that she herself parks over the very yellow lines that she wants to keep others out of. (It should be in your records that I sent you another letter about this and pictures of this same person blocking her walkway with her own car not too long ago). She is the worst offender of her own obsession and to give in to her would be a serious mistake. I resent the fact that these people are trying to exert private control over public roads. I am trying to live a peaceful life and do not like being harrassed by lunatic neighbors, when I am not doing anything wrong. On or about the middle of August of this year there appeared in the area in question painted yellow lines indicating a no parking zone. Residents uf the area were nof given- notice nor were any publications authored informing residents of the impending change in the parking condition therein. I contacted Mayor Zegarelli and Chief Warren inquiring as to the status of the area in question. The mayor informed me that he was not aware mat lineshadbeen paintedr : The chief informed me that this was done at the direction of the mayor.! inquired further as to the law authorizing the change and was informed that none existed. I was however assured that no summonses would be issued for parking in the area, lagain contacted Mayor Zegarelli who meir informed me that the lines were in effect painted to end the complaints he received from the Damin family of 14 Dell Street, Sleepy Hollow NY. On or about the end of August, after my phone calls to officials my mother was visited by Chief Warren informing her of a pending bearing concerning Ike no parking area. She was assured that a certified letter would be sent detailing the proposed change of law as'well as the date ofhearing. None was ever received. Upon receiving mis new mformatkm, 1 ^ of Sleepy Hollow via FOIL certain information so as to prepareforthe hearing. This clearly is in violation ofPublic Officers Law, Article 6. This issue however will be addressed separately at the appropriate venue; Subsequent to enlisting the services of an attorney, I was provided with limited data that was carefully screened. The information requested from the mayorandxhief continues toi>e ignored This^of course limits the possibility of a fair and open evaluation of the proposed law. It is obvious mat the main reason this hearing is being held is to transform a whimsical decision intrr law. Surely, had I not investigated this parking change, the lines would have remained^ this hearing^would nothave beerrconvened anchmdoubtedry, summonses would have been-issued as a resulted of camplainisjeceived. _ This type of unilateral and unauthorized action should not be tolerated and is certainly not in the best interests of the citizens of Sleepy Hollow. THETPROSPOSEDTAMENDMENT Upon information and belief, the Damins have filed hundreds of complaints to the police department and"otherofficials from parking concerns to freer complaints. The exact number is hidden somewhere within the police database. Offensive notes have been placed on vehicles parking in the area advismg them that ti^'are intrudmg on a " prrvate" parking are^ Theyare the-proverbial ""squeaky door "7 Sadly, they have gotten the attention ofat least some elected officials and, moreover, forced them into action. This amendment was recently published as public notice in the local newspaper: Those most directly afrected"by the change were not giventhe^ courtesy of direct notification. The amendment is designed lor the specific benefit of one party requesting it: There is^ virtually no benefit to the common good of the neighborhood and" in fact, there is a negative impact on all other parries in the neighborhood. Parties ha ve unobstructed access to roadway on the Dell Streetside. Considering they enjojrpaiking privileges hrthe lot across fronrtbeir home this would be the obvious solution to their perceived dilemma. 2. Parties seem to believe that once one purchases a home they have exclusiverightto the public roadway at their tear entrance. They ask this board to validate their claim. (Please see attached photo. Parties have deliberately placed obstructions on the walkway adjacent to the area in question, A fence narrows the walkway to the point of making safe passage impossible. They have also piled huge amounts of cedar mulch in theremammgarea thereby causing a slippery and uneven grade. 4. The traffic engineering department of my company j[Harbourtown Security Consultants) conducted an informal parkhig survey in the area over a three-week period? The norm for daytime parking is lone to two vehicles. Therefore, access to a parked vehicle-should^be-easy. Parking during the evening hours is at a premium. Frequent nighttime coming and going of an elderly party with a disability is unlikely. Those others who xely on parking hrthe area shoukrnotrbe deprivedof any existingspace. 5. Should the village allow special treatment in the instant matter, it should notifythe remaining citizens of Sleepy Hollow of its new policy and practice: This would allow those others who do not want vehicles parked near their entrances similar recourse. 6.
