A regular'meeting of the Board of Trustees was held on Tuesday, January 25, 2005 at 8 pm
in Village Hall, 28 Beekman Avenue, Sleepy Hollow, New York.

Mayor Zegarelli called the meeting to order with a prayer and pledge to the flag.
Approval of Minutes
Trustee DiFelice moved, seconded by Trustee Spota to approve the minutes of December
21, 2004, motion carried 6-0-1 with Trustee DiFelice abstaining.
Trustee Spota moved, seconded by Trustee Capossela to approve the minutes of January
11, 2005, motion carried unanimously.
Trustee Capossela moved, seconded by Trustee Grala to approve the minutes of January
18, 2005, motion carried unanimously.
Public Hearings
Trustee Grala read the attached public hearing notice regarding Stormwater Illicit
Discharge. Village Counsel, Robert Ponzini gave a brief explanation as did Dolph
Rothfeld, Village Engineer. There were no comments from the public. Trustee Zieja
moved to close the hearing, seconded by Trustee Murray, motion carried unanimously.
Trustee Zieja read the attached public hearing notice regarding the Senior Housing Special
Permit. Ken Gentile of the North Tarrytown Housing Authority gave a brief explanation
on how much this would help them.
Mr. O'Neill thanked the Mayor and staff for all their help in getting it all this far.
There were no comments from the public. After a brief discussion, Trustee DiFelice moved
to continue this public hearing at the February 8,2005 meeting at 7 pm in the Board room,
motion carried unanimously.
Approval of Warrant
Trustee Spota moved, seconded by Trustee Capossela to approve the warrant of January
25, 2005 minus two payments to the Retirement System. Approval is subject to the review,
approval and signatures of the Mayor and Village Treasurer, motion carried unanimously.
Total of the General fund is S986,230.30, Water &amp; Sewer Department fund total is
S5.632.24, Capital fund total is S18,681.78 and the Parking Authority total is S635J3.

Trustee Capossela moved, seconded by Trustee Grala to approve the two bills in questions,
subject to "confirmation by the Village Treasurer authorizing her to analyze the bills in
order to pay these two bills, motion carried unanimously.
Mayor's Report
Mayor Zegarelli commented that Joe DeFeo and his crew did a fantastic snow removal job.
Mayor Zegarelli commented that Sean McCarthy, our Village Architect has passed all the
New York State code tests.
Trustee Reports
Trustee DiFelice read the attached Public Works Report and commented on the great snow
removal job that Joe DeFeo and his crews did over the past weekend's blizzard.
Trustee Spota also commended Joe DeFeo and his crew on the great snow removal job that
was done during the weekend blizzard.
Trustee Spota reported that the next Public Safety Committee meeting will be held on
Monday, February 28th at 7pm in village hall.
He reported that the Sleepy Hollow Police Department held a hands free for safety
enforcement program from December 13-19. Officers Corona, Hennessey, Cotarello,
Guzzo, Lombardi, Sgt. Hood and Sgt. Eaton participated in the program. A total of 30
summonses were issued for cell phone violations.
A letter was received from the Director of Physical Education and Athletics of Sleepy
Hollow High School thanking Sgt. Hood, Sgt. Hrotko, Officers Checchi, Corona,
Hennessey, Ebel, Quinoy, and Detective Zekus for coming to the high school to be present
during a game with a rival team in case there might be a problem.
Trustee Spota commented that one of our attorneys, Joel Sachs received an Environmental
Attorney award.
Trustee Capossela read the attached Administration Report.
Trustee Capossela also commended Joe DeFeo and his crew for the great snow removal
job.
Trustee Grala reported that she met with the Recreation Commission and Robin Pell
recently.
Trustee Grala commented that the Franchise Committee will meet next week with the
Consortium.
Trustee Grala commented that the steps at the Warner Library crumbled and the
contractor has been contacted to come back to repair it.
Trustee Zieja read the attached Fire Council correspondence. Trustee Capossela moved,
seconded by Trustee Grala to confirm the appointments, motion carried.

Trustee Murray reported that he attended the Council of Committees meeting where all
the committees were brought up to speed on what was happening.
T h e architect for the senior housing on Valley Street went over the designs.

Dave Smith went over commercial land use ideas for downtown Beekman Avenue
revitalization with the development of proposed Lighthouse Landing.
Sean McCarthy went over the new zoning map.
Administrator's Report
Dwight Douglas commented that most of his report has already been covered during the
meeting, but he commented that a public hearing on the garbage revisions will need to be
held.

Mayor's Report
The Mayor was in receipt of turn off notices from Con Ed for 36 Elm Street,
72 Beekman Avenue and 175 Valley Street.
We are in receipt of a letter from Mr. Engle thanking us for trimming the village trees.
We are in receipt of payment of cable franchise for the third quarter in the amount of
SI 9,368.00
Mayor Zegarelli commented that negotiations will be starting shortly with the PBA and the
Teamsters.
The board is in receipt of a letter that Mayor Zegarelli sent to Mayor Janos in response to
his letter regarding the H- Bridge.
Communications, Petitions &amp; Requests
The Village Clerk read letters from the following establishments informing the Village of
their intent to renew their liquor license: T-4-2 Club, 42 Clinton Street, Out of Bounds, 31
Beekman Avenue, National Sokol Club, 155 Beekman Avenue, Fraternal Order of Eagles,
322 North Broadway and the VFW, 228 North Washington Street. Copies have been given
to the Police Chief.

Mayor Zegarelli received correspondence from Robert Williams, Mayor of Elmsford,
thanking our Public Works Department for helping them out when they had a very
difficult water main break by loaning them our vacuum truck to assist. Also, for loaning
them our truck , trailer and driver for their Halloween Party.
There being no further business, Trustee DiFelice moved, seconded by Trustee Murray to
adjourn the meeting, carried.

WHEREAS. AFLAC NY is a local provider of supplemental insurance to municipalities
within New York State: and
WHEREAS. AFLAC NY has provided a proposal to the'Village'of Sleepy Hollowproviding lor a flexible spending program and additional insurance services for the
employees of the Village of Sleepy Hollow; and
WHEREAS, the program will be administered by the Treasurer, therefore, there will be
no additional cost to the Village of Sleepy Hollow or its employees; and
NOW. THEREFORE. BE IT RESOLVED that the Mayor and Board of Trustees, does
hereby execute the agreement with AFLAC, NY. and w ill take any other steps necessary
to effectuate this resolution; and be it further

Resolution adopting a local law on Storm water Management and Erosion Control

WHEREAS, the Village of Sleepy Hollow ("Sleepy Hollow") is charged with the
responsibility and required by law to adopt legislation for Storm water Management and
Erosion &amp; Sediment Control, and
WHEREAS, Sleepy Hollow prepared a draft of a local law that is designed to
accomplish such a purpose and is in compliance with the NYSDEC Storm water Design
Manual and the N.S. Standards and Specifications for Erosion and Sediment Control for
use by the Planning Boards in New York State in reviewing subdivisions and site plan
approvals, and
WHEREAS, this local law will among other provisions, provide for the preparation and
submission of Storm water Pollution Prevention Plans for construction projects over
one(1)acre. and
WHEREAS, in addition to its other requirements, it further provides for updating of the
Sleepy Hollow's zoning, subdivision and site plan requirements in conformance with
these objectives, and the imposition of penalties for the violation thereof, and
WHEREAS, a notice was duly published and a public hearing was conducted on
December 9, 2005 wherein the public was given an opportunity to be heard, and
WHEREAS, after deliberation and review Sleepy Hollow believes this local law is in the
best interests of its residence and complies with all Federal and State requirements,
NOW THEREFORE BE IT RESOLVED, that this local law entitled "Storm water
Management and Erosion &amp; Sediment Control" is hereby adopted. This local law shall
become effective upon filing v/ith the Secretary of State.

Resolution Adopting Zoning Code Amendments
Wireless Communication Facilities
WHEREAS, the Planning Board of the Village of Sleepy Hollow (the Planning Board)
has recently concluded a Generic Environmental Impact Statement (GEIS) process for a
wireless communication facility location plan; and
WHEREAS, as a result of the GEIS process, the Planning Board has prepared a series
of recommendations to Chapter 62-22.2 of the Village Zoning Code regulating wireless
communication facilities; and
WHREAS, the Planning Board has forwarded those comments to the Mayor and
Board of Trustees of the Village of Sleepy Ho'low (the Village Board) for their review and
consideration; and
WHEREAS, on November 16, 2004, at a duly noticed meeting of the Village Board,
said Board did review and discuss the proposed revisions to Chapter 62-22.2; and
WHEREAS, on December 21, 2004 at 8:00 PM at Village Hall, 28 Beekman Avenue,
Sleepy Hollow, New York, the Village Board did open and close a duly noticed public
hearing and did provide an opportunity for the public to comment on the proposed
amendments; and
WHEREAS, Westchester County provided written correspondence on the proposed
amendments indicating that it was a matter of local determination; and,
NOW, THEREFORE, BE IT RESOLVED, that after a review of the environmental
record, the Village Board finds that the proposed action will not have a significant effect on
the environment; and, be it further
RESOLVED, that the Village Board does hereby adopt the proposed amendments to
the Chapter 62-22.2 and does hereby direct the Village Clerk to file the amendments with
the New York State Department of State.

Resolution Adopting Official Zoning Map
Village of Sleepy Hollow
WHEREAS, over the course of time the Village of Sleepy Hollow has adopted amendments to
the zoning designations of selected portions of the Village, including the recent annexation and
zoning of certain lands from the Town of Mt. Pleasant; and
WHEREAS, Village is desirous of updating the official zoning map of the Village of Sleepy
Hollow to accurately reflect the zoning district designations; and
WHEREAS, the Mayor and Board of Trustees of the Village of Sleepy Hollow (the Village
Board) has directed the Village Architect to prepare an updated draft zoning map that reflects all of
the various revisions that have occurred since the official zoning map was last updated; and
WHEREAS, the Village Board did forward the aforementioned updated draft zoning map to
the Village of Sleepy Hollow Planning Board for their review and recommendation consistent with
Chapter 62-53.B. of the Village Zoning Code; and, be it further
WHEREAS, the Planning Board, did provide the Village Board with their recommendations
relative to the updated zoning map; and
WHEREAS, the Village Board did hold a public hearing on the proposed updated draft zoning
map on December 21, 2004 at 8:00 PM at Village Hall and did close said hearing at their
January 11, 2005 meeting; and,
NOW, THEREFORE, BE IT RESOLVED, that the after a review of the environmental record
and the extent of the clarifications to the official zoning map, the Village Board finds that the
proposed action will not have a significant effect on the environment; and, be it further
RESOLVED, that Village Board does hereby adopt the revised zoning map as most recently
amended by the Village Architect's office as the official zoning map of the Village of Sleepy Hollow;
and be it further
RESOLVED, that the Mayor and Board of Trustees does hereby authorize the Village
Architect's office to print sufficient copies of the zoning map for distribution to the various Village

The Assessor of the Village of Sleepy Hollow has prepared the Tentative Assessment
Roll for the current year, and that said Assessment Roll will be filed with the Village
Clerk at her office in the Municipal Building, 28 Beekman Avenue, Sleepy Hollow, New
York on February 1, 2005 where it may be seen and examined by any persons at all times
during business hours between 8:30 AM and 4:30 PM until the 15Ul day of February 2005
and that on such day in the Boaid Room, Municipal Building, 28 Beekman Avenue, in
said Village between the hours of 4PM and 8PM, the Board of Trustees of said Village
will meet for the purpose of hearing complaints in relation thereto, on the application of
any person considering himself aggrieved thereby.

WHEREAS, the Police Chief, having reviewed and verified the information contained in
the Village of Sleepy Hollow Towing Application has recommended that Stiloki's
Automotive be awarded the Village of Sleepy Hollow towing license subject to the
conditions set forth in the Towing Application.
NOW, THEREFORE, BE IT RESOLVED that the Village Board of Trustees hereby
awards Stiloski Automotive the towing license for the period of 01Jan05 to 31Dec05.

The following action occurred at a Special Chiefs Election held on, January 18th,
2005, for the purpose of electing a 1 s t Assistant Chief to replace the resigning Chief.
2nd Assistant Chief William Hennessey was elected to finish the term of the 1 s t

This created a opening for 2 nd Assistant Chief. Daniel Hayes was elected to fill the

Public Works Report
January 25," 2005
We have had 3 small snowstorms in the past month and 1 large storm this past
weekend.
More salt is on order through state bid but the salt companies are having problems
meeting the demands of all the villages and towns, but we do have quite a bit in
reserve.
We are in the process of snow removal to allow emergency vehicles to respond
without problems and to allow the residents to be able to park their cars closer to
the curb.
Equipment is being serviced to get ready for more snow late tonight into Wednesday
and possibly another storm over the weekend.
This spring Lawrence Avenue will be under reconstruction to install a new water
and storm drain system. We will be discussing the possibility of widening Lawrence
Avenue by stepping back the sidewalks.

Columbia Hose Fire Department renovations are ongoing.
A bid will go out in the spring for the replacement of a roof on the Public Works
garage.
Village Hall offices were painted.
More storage area is being created on the third floor.
